Terms of Service

§ 1. General Provisions
- These Terms of Service set out the rules and conditions for using the "Galeria Weselna" application available at https://galeriaweselna.pl (the "Application").
- The service provider is Krzysztof Kucharski (the "Service Provider"), operating as an unregistered sole trader.
- The Service Provider may be contacted by email at: [email protected]
- Before using the Application, the User must read these Terms of Service and the Privacy Policy.
§ 2. Definitions
Terms used in these Terms of Service mean:
- Album – a collection of photos and video materials created by the User within the Application;
- Application– the "Galeria Weselna" web application available at galeriaweselna.pl;
- Guest – a person using a shared Album without the need to create an Account;
- Account – a panel created in the Application system that enables the User to use its features;
- Consumer – a natural person entering into a legal transaction with the Service Provider that is not directly related to their business or professional activity;
- Terms of Service – this document setting out the rules for using the Application;
- User Content – any files, photos, video materials and information uploaded by the User to an Album;
- User – a person who holds an Account in the Application.
§ 3. Technical Requirements
- To use the Application properly, the following are required:
- an Internet connection;
- a device with a web browser (Chrome, Safari, Firefox, Edge);
- JavaScript and cookies enabled;
- an active email account.
- It is prohibited to use viruses, bots or other harmful code, as well as automated scripts.
- The Service Provider uses SSL encryption to protect data transfer, as well as other technical and organisational security measures.
§ 4. Rules of Use of the Application
- The User must use the Application in accordance with applicable law and good practice.
- Providing unlawful content is prohibited.
- The User must provide accurate information. The Service Provider is not liable for the consequences of providing false data.
- A breach of these Terms of Service includes in particular:
- providing unlawful content;
- using the Application contrary to its intended purpose;
- providing false data;
- attempting to interfere with the operation of the Application.
- If a breach of these Terms of Service is identified, the Service Provider may require the User to remedy it, setting a deadline of no less than 7 days.
§ 5. Account Registration
- To create an Account, the User should:
- visit the Application website;
- click the registration button;
- provide an email address and password, or use the Google account login option;
- accept the Terms of Service and Privacy Policy;
- click "Register".
- Clicking "Register" or "Continue with Google" constitutes entering into a service agreement.
- Through the Account, the User may create Albums, manage photos and video materials, and share them with Guests.
- The User may terminate the agreement at any time by deleting the Account. Account deletion takes effect immediately, is irreversible, and results in the permanent deletion of all data associated with that account, including Albums, photos and video materials.
§ 6. Use of Albums by Guests
- The User may share an Album with Guests, enabling them to browse, download and add photos and video materials.
- A Guest does not need to create an Account. Access to an Album is provided via a unique link and identifier associated with a QR code.
- The User may additionally protect an Album with a password.
- The Guest agrees to comply with applicable law. It is prohibited to post content that is:
- unlawful;
- in violation of third parties' personal rights;
- in violation of copyright;
- offensive, discriminatory or pornographic.
- The User is responsible for content posted by Guests and is obliged to moderate it.
- The Guest represents that they hold copyright or licences to the materials they upload and bears sole responsibility for any infringement of third-party rights.
§ 7. Fees and Payments
- Use of the basic features of the Application may be free of charge or paid, depending on the selected package.
- Payments are made using the payment systems available in the Application.
- Prices are quoted in Polish zloty (PLN).
- After payment is credited, the Service Provider sends a transaction confirmation to the email address provided.
§ 8. Copyright and Licences
- The User retains full copyright in the Content they upload.
- By uploading Content, the User grants the Service Provider a free, non-exclusive licence to use it solely for the purpose of providing services within the Application.
- All elements of the Application (logo, interface, code) are protected by law.
- Any use of elements of the Application without the Service Provider's consent is prohibited.
§ 9. Service Provider Liability
- The Service Provider undertakes to provide services with due care.
- The Service Provider is not liable for:
- content uploaded by Users and Guests;
- use of the Application contrary to its intended purpose;
- incorrect data provided by the User;
- disclosure of access credentials by the User to third parties.
- The Service Provider is not liable for interruptions in the operation of the Application resulting from:
- force majeure;
- maintenance and upgrade work;
- causes beyond the Service Provider's control.
§ 10. Right of Withdrawal from the Agreement
- A Consumer has the right to withdraw from the agreement without giving any reason within 14 days of the date of its conclusion.
- The right of withdrawal is exercised by submitting a statement to: [email protected]
- If the Consumer withdraws from an agreement for a service that has not been fully performed, the Service Provider refunds the price reduced by the value of the services already used.
- The refund is made within 14 days of receipt of the withdrawal statement.
§ 11. Complaints
- Complaints may be submitted to: [email protected]
- A complaint should include: full name, email address, description of the problem and the requested remedy.
- The Service Provider considers complaints within 14 days of receipt.
- The response to a complaint is sent to the User's email address.
§ 12. Personal Data Protection
Information on the processing of personal data is set out in the Privacy Policy.
§ 13. Out-of-Court Dispute Resolution
- A Consumer may use out-of-court procedures for handling complaints and pursuing claims.
- Detailed information on the availability of out-of-court dispute resolution procedures and access to those procedures is available, among others, on the websites of the Office of Competition and Consumer Protection (UOKiK), municipal and district consumer ombudsmen, and Voivodeship Inspectorates of Trade Inspection.

§ 14. Changes to the Terms of Service
- The Service Provider may amend these Terms of Service in the event of:
- changes in applicable law;
- introduction of new features;
- the need to adapt to new devices or technologies.
- Users will be informed of changes to the Terms of Service on the Application website.
- A User who does not agree to a change may terminate the agreement within 10 days of publication of the amended Terms of Service.
§ 15. Final Provisions
- These Terms of Service enter into force on 19 May 2026.
- These Terms of Service are governed by Polish law.
- Disputes will be resolved amicably, and if no agreement is reached – by the court having jurisdiction over the Service Provider's place of residence.
- Matters not regulated herein are governed by Polish law.
